Important: By accessing or using the services of Conscious Connections, you agree to these Terms and Conditions ("Terms") as well as our Privacy Policy. Please read these Terms carefully before creating an account.

1. Introduction and Contracting Party

Welcome to Conscious Connections! These Terms govern your use of the Conscious Connections mobile application (the "App") and all related services, features, and content (collectively, the "Services").

You and Conscious Connections are collectively referred to as the "Parties" or individually as a "Party".

Changes to the Terms: We may amend these Terms from time to time. In the event of material changes, we will notify you by email, in-app notification, or other means. Your continued use of the Services after amended Terms take effect constitutes your acceptance of the changes. If you do not agree to the changes, you must discontinue your use of the Services.

2. Eligibility and Your Responsibilities

2.1 Eligibility

You may only create an account or use the Services if all of the following conditions are met, and by using our Services you represent and warrant that:

  • you are a natural person (not a legal entity) and at least 18 years old;
  • you are legally capable of entering into a binding contract with Conscious Connections;
  • you are not legally prohibited from using our Services;
  • you have not committed any crimes involving violence, the threat of violence, or sexual misconduct, nor have you been convicted of such offences;
  • you are not required to be registered on a sex offender registry;
  • you have not previously been excluded from our Services, unless you have our express written permission to create a new account.

If at any time these conditions are no longer met, your authorisation to use the Services is automatically revoked, and you must immediately delete your account. We reserve the right to delete your account at our sole discretion and without prior notice.

2.2 Your Responsibilities

You agree to:

  • comply with these Terms and regularly check this page for changes;
  • comply with all applicable laws, including data protection, copyright, anti-spam, and consumer protection laws;
  • use the most current version of the App;
  • treat other users courteously and respectfully — both within and outside our Services;
  • communicate respectfully with our support team and other staff;
  • take reasonable measures to protect your account and login credentials;
  • comply with our Community Guidelines (where provided).

2.3 Prohibited Conduct

You agree not to:

  • misrepresent your identity, age, occupation, qualifications, or affiliations with any person or organisation;
  • use the Services in a way that damages them or prevents other users from using them;
  • disrupt or interfere with the platform, servers, or networks of our Services;
  • use the Services for harmful, illegal, or fraudulent purposes;
  • harass, bully, threaten, defame, or otherwise mistreat other persons;
  • publish or share prohibited content (see Section 2.4);
  • solicit passwords or personal data from other users for commercial or unlawful purposes;
  • solicit money or other items of value from other users, whether as a gift, loan, or compensation;
  • use another person's account or share your account with another person;
  • use the Services in connection with fraud, pyramid schemes, or similar practices;
  • use the Services for political campaign financing or to influence elections (other than expressing personal political opinions);
  • copy, modify, transmit, or distribute content, images, trademarks, or other intellectual property without prior written consent;
  • use robots, crawlers, scrapers, or automated processes to access the Services;
  • upload viruses or malicious code or otherwise compromise the security of our Services;
  • "frame" or "mirror" any part of our Services without our prior permission;
  • modify, adapt, translate, reverse-engineer, or decompile any part of the Services;
  • allow third-party applications or services (including AI or machine learning systems) to interact with our Services or Member Content without our written consent;
  • submit false, misleading, or manifestly unfounded reports about other users or abuse our reporting or complaints system;
  • create a new account after your account has been suspended or deleted without our express consent.

2.4 Prohibited Content

The uploading or sharing of the following content is prohibited:

  • content that could reasonably be considered offensive or that harasses, upsets, or embarrasses other persons;
  • obscene, pornographic, violent, or nude content;
  • abusive, insulting, threatening, or discriminatory content; content that promotes racism, sexism, hatred, or bigotry;
  • illegal content or content that promotes illegal activities (including terrorism, human trafficking, child abuse, or incitement to violence);
  • content that promotes self-harm, eating disorders, dangerous challenges, or harmful misinformation;
  • defamatory or untruthful content;
  • content relating to commercial activities (including sales, employment or investment offers, "sugar daddy"/"sugar baby" relationships, sex services), unless expressly permitted within the business features;
  • spam or "junk mail";
  • spyware, adware, viruses, worms, or other malicious code;
  • content that infringes the rights of third parties (including intellectual property and personality rights);
  • images or depictions of other persons without their consent (for minors, without the consent of parents or legal guardians);
  • images or depictions of minors who are unaccompanied, not fully clothed, or depicted in a sexually suggestive manner;
  • content that is inconsistent with the purpose of the Services;
  • content that could damage the reputation of Conscious Connections or Aluria AG.

The uploading or sharing of prohibited content may result in the immediate suspension or deletion of your account.

3. Content

3.1 Your Content

While using our Services, you may access the following content: (i) content you upload, provide, or share ("Your Content"); (ii) content other users upload or provide ("Member Content"); and (iii) content provided by Conscious Connections ("Our Content").

You are solely responsible and liable for Your Content. You warrant that all information you provide is truthful and that you will update your profile as necessary to ensure its accuracy.

You may not display personal contact details, banking, or payment information in your profile or in messages (e.g., home address, phone number, email addresses, URLs, credit card or bank details). If you choose to disclose such information, you do so at your own risk.

Your profile is visible to other users. Therefore, do not upload content you do not wish to share. You acknowledge that Your Content may be viewed by other users and potentially shared with third parties.

No Screenshot Protection: You acknowledge that the App does not offer screenshot protection. Content you share (including photos and private messages) may be captured by recipients via screenshot or screen recording and may be redistributed. Please exercise caution with what you share.

We may monitor, remove, edit, or block Your Content at any time and at our sole discretion. However, we are not obligated to review or display Your Content.

3.2 Member Content

Member Content belongs to the user who published it. You have no rights to Member Content and may only use it within the intended purpose of the Services (communicating with and meeting other members). You may not copy Member Content or use it for commercial purposes, spam, harassment, or unlawful threats.

Member Content may contain biased, inaccurate, harmful, offensive, or misleading information. Conscious Connections expressly assumes no responsibility for Member Content.

3.3 Our Content

All text, graphics, user interfaces, trademarks, logos, images, and other intellectual property appearing in our Services is the property of Conscious Connections or our licensors and is protected by copyright, trademark, and other intellectual property rights. We grant you a limited licence to access and use Our Content in accordance with Section 7.

4. Inappropriate Content and Reporting

We do not tolerate inappropriate content or behaviour on our Services. We encourage you to report inappropriate Member Content or misconduct by other users. You can report a user via the "Report" function on their profile or in the messaging area. You can also contact our support team at support@conscious-connections.com.

In the event of violations of these Terms, we may take appropriate measures, including suspending your account and preventing the creation of new accounts. Manifestly unfounded reports may result in measures against the reporter.

We use a combination of automated tools and human reviewers to enforce our content rules. Serious violations (e.g., child sexual exploitation material or terrorist content) will result in immediate suspension.

5. Privacy

For information on how we collect, use, and share your personal data, please refer to our Privacy Policy. By using our Services, you agree that we may use your personal data in accordance with this policy.

6. Newsletter and Marketing Communications

During registration, you have the option to subscribe to our newsletter. If you consent to this option, you will receive regular information about events, news, and offers from Conscious Connections by email. Emails are sent via our service provider Kit (formerly ConvertKit). You may unsubscribe from the newsletter at any time by using the unsubscribe link at the bottom of each email or by adjusting your preferences in the App. Unsubscribing does not affect your use of the other Services. For further information on how your data is processed in connection with the newsletter, please refer to our Privacy Policy.

7. Your Rights to the Services

As long as you comply with these Terms, we grant you a personal, worldwide, royalty-free, non-transferable, non-exclusive, revocable, and non-sublicensable licence to access and use our Services for the purposes intended by Conscious Connections and permitted by applicable law. This licence is automatically revoked if you violate these Terms.

8. Rights You Grant Us

You remain the owner of all content you provide to us. However, by creating an account, you grant us a worldwide, perpetual, transferable, sublicensable, royalty-free licence to host, store, use, copy, display, reproduce, adapt, edit, publish, translate, modify, incorporate into other works, advertise, and distribute Your Content — in whole or in part and in any format or medium currently known or hereafter developed.

You further grant us the right to use Your Content to (a) fulfil our obligations and exercise our rights under these Terms; and (b) further develop and improve the Services and other products or services.

The licence granted to us in Your Content is subject to your rights under applicable law (e.g., data protection law). In consideration for your use of our Services, you agree that we and our partners may place advertising on our Services. You agree that any feedback or suggestions you provide to us may be used by us without compensation to you.

9. Purchases and Automatically Renewing Subscriptions

9.1 External Purchases (App Store / Google Play)

If you make a purchase through an external service (e.g., Apple App Store, Google Play), your external account will be charged in accordance with the terms disclosed at the time of purchase. Subscriptions will automatically renew until you cancel.

To cancel a subscription purchased through an external service, you must log in to your external account and follow the cancellation instructions provided there. Simply deleting the App or your Conscious Connections account is not sufficient to end an external subscription.

9.2 Virtual Items and In-App Purchases

We may from time to time offer you the opportunity to purchase virtual items or additional features. Virtual items are non-transferable and are subject to this agreement. They do not represent real-world balance but merely a limited licence to use.

All purchases and redemptions of virtual items are final and non-refundable, unless otherwise required by mandatory statutory provisions.

9.3 Refunds

All purchases are generally final and non-refundable, unless applicable law in your jurisdiction provides for refunds.

For subscribers in the EU, EEA, Switzerland, and the United Kingdom: In accordance with applicable law, you are entitled to a full refund within 14 days of the start of the subscription (right of withdrawal). This 14-day period begins when the subscription starts. The right of withdrawal may expire upon commencement of use of digital content before the end of the withdrawal period, provided you have given your express consent.

If you subscribed via your Apple ID, refund requests are handled by Apple, not Conscious Connections. Please contact Apple Support. For other purchases, please contact support@conscious-connections.com.

10. Account Termination

You may delete your account at any time by logging into the App, going to "Settings", clicking "Delete Account", and following the instructions. Please note that subscriptions purchased through external services (e.g., Apple App Store, Google Play) must be cancelled separately via the respective external account.

We further reserve the right to suspend, terminate, or close your account without refund if we believe that you have violated these Terms, misused our Services, or behaved in a manner that we consider, at our sole discretion, to be inappropriate or unlawful. We may use legal, technical, and other available measures in doing so.

Upon account termination, this agreement remains in force and enforceable between you and us. You are not entitled to a refund of purchases made. Your data will be handled and deleted in accordance with our Privacy Policy.

11. No Background Checks — Personal Responsibility

Conscious Connections does not conduct criminal background checks or identity verifications on its users. We make no representations or warranties regarding the conduct, identity, health, physical condition, intentions, legitimacy, or truthfulness of users.

You are solely responsible for your interactions with other users. We cannot guarantee your safety. Please always exercise caution and good judgment, particularly if you choose to communicate outside the Services or meet in person.

Tips for meeting in real life:

  • Meet in public places for the first few encounters.
  • Inform a trusted person about your meeting.
  • Do not share sensitive personal or financial information.
  • Never transfer money to people you have met on the App.
  • Report suspicious or inappropriate behaviour immediately.

Communications through our Services, including automatic notifications, may originate from users who are using our Services for inappropriate purposes (fraud, abuse, harassment).

12. Events and Bookings

Our Services allow users to discover events and event organisers to publish such events. Please note the following:

12.1 Participation in Events

If you attend an event discovered through the App, the contract for participation is entered into exclusively between you and the respective event organiser. Conscious Connections is neither a contracting party nor an organiser and assumes no responsibility for the execution, quality, safety, or content of events advertised through the App.

Bookings, payments, cancellations, and refunds are handled directly with the event organiser, unless expressly stated otherwise. The respective terms and conditions of the event organiser apply.

12.2 Event Organisers (Business Users)

If you use the App as an event organiser, you warrant that you are authorised to conduct the events offered and that all information you provide (description, date, location, price) is truthful and complete.

You are solely responsible for:

  • conducting the event in accordance with its description;
  • compliance with all applicable laws and regulations (including commercial, tax, and insurance requirements);
  • the safety of participants;
  • claims from participants (e.g., in the event of cancellations, defects, or damages).

We reserve the right to remove events that violate these Terms, applicable law, or our values.

13. Disclaimer

Our Services are provided "as is" and "as available". To the extent permitted by applicable law, we make no warranty for the Services (including all content contained therein), in particular no implied warranty of satisfactory quality, merchantability, fitness for a particular purpose, or non-infringement of third-party rights.

In particular, we make no representation or guarantee that:

  • our Services will be uninterrupted, secure, or error-free;
  • defects or errors in our Services will be discovered or corrected;
  • content or information you obtain through our Services will be accurate, complete, current, or suitable for your purposes;
  • a certain number of active users exists or that users will want to or be able to communicate with you or meet you;
  • users who contact you through our Services will be compatible with you or will behave appropriately.

Conscious Connections assumes no responsibility for content published, sent, or received by you or other users, nor for the identity, intentions, legitimacy, conduct, or truthfulness of users.

14. Advertising and Third-Party Content

Our Services may contain advertising and offers from third parties as well as links to other websites or resources. We are not responsible for the availability (or lack thereof) of external websites or their content. We assume no liability for products or services offered by third-party providers. If you interact with such third-party providers, their own terms and conditions apply.

15. Limitation of Liability

To the extent permitted by applicable law, Conscious Connections, our affiliates, employees, licensors, and service providers shall in no event be liable for any indirect, incidental, exemplary, special, punitive, or consequential damages, including loss of profits, data loss, loss of use, reputational damage, or other intangible losses arising from:

  • your access to, use of, or inability to access or use the Services;
  • the conduct or content of other users or third parties;
  • any unauthorised access to, use of, or alteration of Your Content.

To the extent permitted by applicable law, our total liability for all claims in connection with the Services is limited to the greater of: (a) CHF 100 or (b) the amount paid by you to us in the 12 months preceding the event giving rise to the claim.

These limitations of liability do not apply to damages arising from injury to life, body, or health, to damages resulting from wilful or grossly negligent breach of duty on our part, or to claims under product liability law or other mandatory statutory liability provisions.

16. Intellectual Property and Copyright

We take copyright infringement very seriously. If you believe that any Member Content or Our Content infringes your intellectual property rights, please send a detailed notice to support@conscious-connections.com including the following:

  • your contact details (name, address, email, phone);
  • details of the copyrighted work;
  • details of the allegedly infringing content and its location;
  • a statement that you believe in good faith that the use of the material is not authorised by the rights holder, their representative, or the law;
  • a statement that the information is accurate and that you are authorised to act on behalf of the rights holder.

We will terminate the accounts of users who repeatedly infringe copyright.

17. Dispute Resolution and Governing Law

17.1 Governing Law

These Terms and any disputes arising from or in connection with your use of the Services are governed exclusively by Swiss law, excluding the conflict of laws rules of private international law and the United Nations Convention on Contracts for the International Sale of Goods (CISG). Mandatory consumer protection provisions of your country of residence remain unaffected.

17.2 Informal Dispute Resolution

If you are dissatisfied with our Services for any reason, please first contact our customer support at support@conscious-connections.com. We will endeavour to resolve your concerns without external assistance.

If a dispute cannot be resolved informally within 60 days, either party may initiate the steps described in Section 17.3.

17.3 Jurisdiction

The exclusive place of jurisdiction for all disputes arising from or in connection with these Terms is Zug, Switzerland, unless mandatory statutory provisions prescribe a different jurisdiction. Consumers residing in the EU, EEA, or the United Kingdom may bring proceedings before the courts of their place of residence.

17.4 EU Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr. However, we are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration body.

18. General Provisions

18.1 Severability Clause

Should any provision of these Terms be or become wholly or partially invalid or unenforceable, the validity of the remaining provisions shall not be affected. The statutory provision shall apply in place of the invalid or unenforceable provision.

18.2 Entire Agreement

These Terms (including the Privacy Policy and any additional terms for specific features or purchases) constitute the entire agreement between you and Conscious Connections with respect to the Services and supersede all prior agreements.

18.3 Assignment

You may not assign these Terms or the rights granted herein without our prior written consent. Conscious Connections may assign these Terms to third parties at any time, in particular in connection with a company sale, merger, or reorganisation.

18.4 No Waiver

Our failure to enforce any right or provision of these Terms in any individual case shall not constitute a waiver of future enforcement of that right or any other rights.

18.5 Survival

Provisions that by their nature are intended to survive the termination of this agreement (including the sections on content, liability, dispute resolution, and governing law) shall remain in force after termination.
